BREITBART – New Supreme Court Justice Samuel Alito split with the court’s conservatives Wednesday night, refusing to let Missouri execute a death-row inmate contesting lethal injection.

Alito, handling his first case, sided with inmate Michael Taylor, who had won a stay from an appeals court earlier in the evening. Chief Justice John Roberts and Justices Antonin Scalia and Clarence Thomas supported lifting the stay, but Alito joined the remaining five members in turning down Missouri’s last-minute request to allow a midnight execution.

The court’s split vote Wednesday night ended a frenzied day of filings. Missouri twice asked the justices to intervene and permit the execution, while Taylor’s lawyers filed two more appeals seeking delays.

Oh geez, what’s next? I bet it’s our civil liberities.

    WASHINGTON —New Supreme Court Justice Samuel Alito cast his first vote on Wednesday, as the court refused to give Missouri permission to immediately execute a man who killed a teenage honor student. The court’s 9-0 action was procedural, however, because a stay was already set to expire Wednesday afternoon.

    Well a cynic might say they figured it was going to be a 5-4 stay anyway, why not let Alito stand out on this one.

    For what it’s worth I’m not a cynic, I think Justice Alito will decide cases the way he reads the facts.

    [...] What??? The man was black? And Alito sided to be cautious on killing him? But, Kennedy said he was a racist bigot! Expose the Left also talks about the overreaction of Kennedy and his cohorts. I say to the Conservative base, don’t overreact on this in the opposite direction. This was his first case, and not nearly enough to make a good judgement on. Hey, this guy is in there…for LIFETIME appointment….We put him there. Don’t judge this guy as the new Kennendy-Souter mistake, at least not yet. To do that is nothing more than knee jerk judgement. Give him a chance.     I agree with STACLU….. I heard what Alito said in his confirmation hearings, that he would make decisions when and ONLY when he had the full facts of the case. He hadn’t had ENOUGH time to hear or read the full case, so I think he made a correct, strict constitutionalist move!... He wants more time to be apprised of the entire case – had he done otherwise, and voted IMMEDIATELY for the libs, they left would have said “AHA! WE TOLD YOU HE WAS GOING TO LEGISLATE FROM THE BENCH!”..

    I say, good move by Alito
